Acceptance of Terms
These Terms of Service govern your access to and use of Mobilens, a SaaS platform that helps businesses analyze App Store, Google Play, and related mobile product data. By accessing or using Mobilens, creating an account, or placing an order, you agree to be bound by these terms.
If you use the service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these terms. If you do not agree, do not use the service.
Description of Service
Mobilens provides reporting, dashboards, and analytics workflows for mobile app teams. The service may collect, normalize, and analyze information such as app listing metadata, ratings, reviews, release signals, and other data you authorize us to access or provide to us.
We may update features, interfaces, and product limits over time. We will use commercially reasonable efforts to keep the service available, but we do not guarantee uninterrupted availability, compatibility with every third-party platform, or that every insight generated by the service will be error-free.
- You are responsible for the accuracy of the information you submit and for maintaining lawful rights to use that information.
- You may not use Mobilens to violate platform terms, scrape data unlawfully, interfere with the service, or attempt unauthorized access.
- You may not use the service to build a competing product by copying core workflows, models, or outputs at scale.
Payment & Billing
Paid plans are billed in advance on a subscription basis according to the pricing and billing interval presented at checkout or in your order form. Unless otherwise stated, fees are non-refundable except where required by law.
You authorize Mobilens and its payment processors to charge the payment method associated with your account for subscription fees, upgrades, taxes, and any applicable overage charges. You are responsible for keeping billing information current.
- Plan changes may take effect immediately or at the next renewal date, depending on the product flow presented at purchase.
- If payment cannot be collected, we may suspend or downgrade access until the account is brought current.
- Prices may change on renewal with prior notice.
Data & Privacy
As between the parties, you retain ownership of the data, content, and app information you submit to Mobilens or instruct Mobilens to process on your behalf. We use that information to operate, secure, support, and improve the service, and to generate analytics, summaries, and recommendations for your workspace.
You grant Mobilens a limited right to host, process, transmit, and display your data as necessary to provide the service. Our handling of personal data is described in the Mobilens Privacy Policy.
- You remain responsible for having an appropriate legal basis to use and share app-related data with Mobilens.
- We may create aggregated and de-identified usage statistics that do not identify you or your end users.
- We do not claim ownership of your underlying business data or app store content that belongs to you.
Intellectual Property
Mobilens, including its software, design, models, documentation, branding, and all related intellectual property rights, is and remains the property of Mobilens and its licensors. Except for the limited rights expressly granted in these terms, no rights are transferred to you.
Subject to your compliance with these terms, Mobilens grants you a limited, non-exclusive, non-transferable, non-sublicensable right to access and use the service during the applicable subscription term for your internal business purposes.
Termination
You may stop using the service at any time and may cancel a paid subscription effective at the end of the then-current billing period unless your order form states otherwise. Mobilens may suspend or terminate access if you materially breach these terms, fail to pay fees when due, or use the service in a way that creates legal, security, or operational risk.
Upon termination, your right to use the service ends immediately. We may delete or anonymize account data according to our retention practices, except where retention is required by law or needed to resolve disputes or enforce our agreements.
Limitation of Liability
To the maximum extent permitted by law, Mobilens and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunities arising out of or related to the service.
To the maximum extent permitted by law, the aggregate liability of Mobilens for all claims arising out of or relating to the service or these terms will not exceed the amount you paid to Mobilens for the service in the twelve months before the event giving rise to the claim.
Governing Law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any dispute arising out of or relating to these terms or the service will be brought in the state or federal courts located in Delaware, and each party consents to the personal jurisdiction and venue of those courts.
If any provision of these terms is found unenforceable, the remaining provisions will remain in effect.
